Please read these Terms of Use carefully before using the SugarSmart app or any SugarSmart LLC product. By downloading or using SugarSmart, you agree to be bound by these terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using SugarSmart ("the App"), operated by SugarSmart LLC ("we," "us," or "our"), you agree to these Terms of Use in their entirety. These Terms apply to all versions of the App, including Sugar Smart and Sugar Smart Meals.

2. Not a Medical Device — No Medical Advice

SugarSmart is a personal health logging and informational tool only. It is NOT a medical device, does NOT provide medical advice, diagnosis, or treatment, and has NOT been cleared or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority.

Nothing in the App — including glucose readings, trend data, alerts, action plans, meal grades, nutritional estimates, AI-generated food identifications, or any other feature — constitutes or should be construed as medical advice. The App must never be used to:

THIS APP IS NOT MONITORED IN REAL TIME BY HEALTHCARE PROFESSIONALS AND CANNOT ALERT EMERGENCY SERVICES.

Do not rely on SugarSmart during a severe hypoglycemic (low blood sugar) or hyperglycemic (high blood sugar) crisis, or any other medical emergency. The App may experience delays, errors, connectivity failures, or complete unavailability at any time. In a medical emergency, call 911 or your local emergency number immediately and contact your healthcare provider.

3. No Professional Relationship

Downloading or using the App does not create a doctor-patient relationship, therapist-client relationship, or any other professional or fiduciary relationship between you and SugarSmart LLC or any of its employees, contractors, or affiliates. We are a software company, not a healthcare provider.

4. Not an FDA-Regulated Medical Device

SugarSmart is not a certified continuous glucose monitor (CGM), FDA-cleared diagnostic tool, or regulated medical device of any kind. Glucose data displayed in the App is either manually entered by you or imported from third-party devices and services. We make no representations about the accuracy or reliability of any glucose readings. You assume full responsibility for verifying the accuracy of all data entered into or displayed by the App.

You must be at least 13 years old to use SugarSmart. By using the App, you represent that you meet this age requirement. Users under 18 should use the App only with parental guidance and supervision.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@sugarsmart.app if you believe your account has been compromised.

You retain ownership of all health data you enter into SugarSmart. By using the App, you grant SugarSmart LLC a limited license to store and process your data solely to provide the App's features. The App is not a HIPAA-covered entity. While we implement reasonable technical safeguards to protect your data, we cannot guarantee absolute security. You assume responsibility for the accuracy of all biometric values you manually input or sync through the App. See our Privacy Policy for full details on what data we collect and how it is used.

10. Nutritional Data Accuracy

SugarSmart uses third-party food databases — including the USDA FoodData Central — and AI-powered food recognition to provide nutritional information. While we apply checks to improve accuracy, nutritional data and AI estimates may not always be correct.

Always verify carbohydrate counts, calorie values, and all other nutritional information against the physical nutrition label on your food product before making any dietary or insulin dosing decisions. SugarSmart LLC is not responsible for inaccuracies in third-party database entries or AI-generated estimates.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY OF ANY GLUCOSE DATA, NUTRITIONAL INFORMATION, AI FOOD SCAN RESULTS, OR GLUCOSE GRADE SCORES. YOU USE THE APP ENTIRELY AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUGARSMART LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY PHYSICAL HARM, FLUCTUATING BLOOD GLUCOSE CONSEQUENCES, HYPOGLYCEMIC OR HYPERGLYCEMIC EVENTS, MEDICAL EMERGENCIES, OR HEALTH OUTCOMES ARISING FROM RELIANCE ON APP DATA, TRACKING FEATURES, AI RESULTS, OR SOFTWARE ERRORS.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY U.S. DOLLARS ($50), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless SugarSmart LLC and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your reliance on App data, insights, glucose grades, AI food scan results, or any other App feature; (c) your violation of these Terms; or (d) any third-party claim resulting from your use of the App's tracking data or features.

14. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration. The arbitration shall be conducted in Florida, United States. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

15. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the updated Terms. We will update the date at the top of this page when changes are made. For material changes, we will make reasonable efforts to notify you through the App or by email.

16. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
