Please read these Terms of Use carefully before using the SugarSmart app. By downloading or using SugarSmart, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using SugarSmart ("the App"), operated by SugarSmart LLC ("we," "us," or "our"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. Not Medical Advice

SugarSmart is not a medical device and does not provide medical advice. The App is designed as a personal health tracking tool only. Nothing in the App — including glucose alerts, insights, recommendations, or action plans — should be construed as medical advice or used as a substitute for professional medical judgment.

Always consult your physician or qualified healthcare provider before making any changes to your diabetes management, medications, or treatment plan. In an emergency, call 911 or your local emergency number immediately.

3. Eligibility

You must be at least 13 years old to use SugarSmart. By using the App, you represent that you meet this age requirement. Users under 18 should use the App with parental guidance.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@sugarsmart.app if you believe your account has been compromised.

5. Subscriptions & Billing

SugarSmart offers optional premium subscriptions (monthly and annual) processed through Apple's App Store. By purchasing a subscription:

• Payment is charged to your Apple ID at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds are provided for partial subscription periods

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or hack the App
• Share your account with others
• Upload false or misleading health data to manipulate the App's features

7. Health Data

You retain ownership of all health data you enter into SugarSmart. By using the App, you grant SugarSmart LLC a limited license to store and process your data solely to provide the App's features. See our Privacy Policy for full details.

8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GLUCOSE ALERTS WILL ALWAYS FIRE AS EXPECTED. YOU USE THE APP AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUGARSMART LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING ANY HEALTH OUTCOMES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the new Terms. We will update the date at the top of this page when changes are made.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
